As drivers in New Jersey, we understand and make all efforts to follow the rules of the road when in suburban Summit and Westfield or urban Newark and Jersey City. However, when it comes to a very important non-moving regulation – namely obtaining and maintaining a minimum of insurance coverage – many drivers think they are above the law. The real problem is that any other vehicle that gets into an accident with an uninsured or underinsured motorist will have a real challenge collecting the compensation they need to pay for medical treatment and cover lost wages.

Motorcycle riders may love the freedom that comes with riding rather than driving a car or truck. However, that freedom comes with serious risks.
Knowing all these facts, the real question is this: if you are in a motorcycle crash with a driver who failed to maintain the proper insurance, what do you do? The same question goes for hit and run accidents. Who pays for your medical treatment and compensates you? Others who were injured or whose property was damaged?
The answers are simple: as an informed motorcycle rider, it’s imperative to carry the maximum amount of Uninsured/Underinsured Coverage you can purchase. State law requires a minimum of insurance; motorcyclists should protect themselves by carrying a policy that will cover them for the maximum amount possible.
Here’s why: If you get into an accident with someone who carries the minimum amount of liability insurance ($15,000) required by law, the most you can get from the other driver’s insurance company is $15,000. If they have no insurance or they are an unknown driver from a hit-and-run accident, you have no one to sue for damages.
Let’s say you also carry only the minimum amount of Uninsured/Underinsured Motorist Insurance ($15,000) on your motorcycle insurance policy. Now, the maximum in compensation you can hope to receive is still only $15,000 as you can only collect on a UIM policy the amount in excess of the defendant’s policy.
On the other hand, if you carry the maximum amount of Uninsured/Underinsured Motorist coverage — $500,000 offered by some insurance carriers – you may be able to collect up to that amount when you’ve been seriously injured in a motorcycle accident. Again, you can sue your own insurance company for any amount over and above the amount of the other driver’s policy.
You may be very surprised to know that the difference between the minimum $15,000 Uninsured/Underinsured Motorist insurance policy and the maximum $500,000 policy could be as little as $1 per day! However, the difference between $15,000 and $500,000 when you’ve been injured is obviously immense.
